Practice Summary

Alice Kelly is based in Chicago where she practices commercial litigation with an emphasis on trademark and franchise disputes.  Ms. Kelly's cases range from simple vendor disputes to complex commercial cases.  Ms. Kelly has tried cases in federal, state and arbitral forums throughout the country and handles matters before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. Prior to joining Norvell IP, she practiced with global law firm DLA Piper and ran her own firm for seven years. Despite a busy litigation practice, Ms. Kelly has always devoted significant time to her community, including extensive pro bono representation of children.  Ms. Kelly is licensed in Illinois, California and Missouri and has lived in Chicago, San Francisco and St. Louis.

Permanently enjoined terminated franchisee from selling catering services under client’s Marks.

Permanently enjoined online seller from infringing client's federally registered trademarks in connection with selling a competing product.

Permanently enjoined terminated franchisees from infringing on franchisor's trademarks and violating post-termination covenant not to compete and compelling franchisees to surrender premises of their former store.

Successfully dismissed claims brought against asset purchaser on a successor liability theory brought by creditor of former owner. 

Won arbitration for charity which detrimentally relied on a charitable pledge donor later tried to revoke.

Won verdict for franchisor in suit brought by a terminated Area Director under the Wisconsin Fair Dealership Law.

Prevailed in arbitration brought by franchisor against former real estate brokerage franchisee under the Illinois Franchise Disclosure Act.

Permanently enjoined former franchisee from violating post-termination covenant not to compete and compelled arbitration of counter-claims resulting in opinion construing Green Tree Financial in the franchise context.

Second chair in trial defeating claims brought by a certified class of consumers seeking over $2 billion from a Big Three automotive manufacturer.

Successfully obtained multi-district litigation from the J.P.M.L. of numerous class actions pending against Big Three automotive manufacturer.

Obtained jury verdict in trial involving valuation of a condemned strip mall in St. Louis County garnering an additional $1.2 million for the client.
